Village Board Minutes

November 7, 2018 (23)

A public hearing & regular meeting of the Village Board was held November 7, 2018 at 6:00PM in the Firehouse, 16 Saratoga Avenue.

Mayor Morreale called the meeting to order & led the Pledge of Allegiance.

Roll Call: Trustee Enekes, Trustee Halliday & Trustee Kelly were present.  Trustee Pasquarell was excused.

A public hearing having been duly advertised in the October 29, 2018 Post Star was held at 6:00 PM to allow public comment regarding Local Law 2 of 2018 amending Chapter 500 (Zoning) of the Village Code.

Jim Martin of LA Group was present to answer public questions.

PUBLIC COMMENTS, QUESTIONS & CONCERNS – none.

The Village has not received final approval from Saratoga County Planning in order to enact the proposed law; therefore the public hearing was left open to be continued on December 5, 2018 at 6:00 PM.

A regular meeting of the Village Board was held at 6:07PM.

Motion by Trustee Kelly, seconded by Trustee Enekes, approved minutes of October 17, 2018 regular meeting as typed.
Carried – 3 – 0

CORRESPONDENCE

The Board received a letter from Joseph Leuci, Foothills Builders, requesting payment of previously tapped water lines in the Passarelli Water District be at the $2,000 connection fee in place when the taps were initially installed. 

Resolution #32 approved, that remaining water taps in Passarelli District that are in existence, but not currently developed be charged $2,000 per connection.

DEPARTMENT REPORTS

CLERK/TREASURER – Clerk-Treas Colson was present, report for 11/7/18 read & filed.

Motion by Trustee Enekes, seconded by Trustee Kelly, approved payment of abstract #10: Payroll $32,627.49; General $63,103.37; Water $6,805.19; Sewer $12,650.06; and Community Development $25,855.00.
Carried – 3 – 0

FIRE DEPARTMENT – Chief Kelley was present, report for October 2018 read & filed.

Mayor Morreale congratulated Nick Milligan & Chad Burnham for recently completing Firefighter 1 training.

DPW/WATER/WWTP – Supt Lozier was present, report for October 2018 read & filed.

Motion by Trustee Kelly, seconded by Trustee Enekes, approved publication of No Parking on Village streets November 1 – April 1 between 11p.m. and 6a.m.
Carried – 3 – 0

Motion by Trustee Enekes, seconded by Trustee Kelly, authorized publication of request for proposals for towing services to be received by November 28, 2018 at 2p.m.
Carried – 4 – 0

BUILDING INSPECTOR – Insp Hepner was present, report for 11/7/18 read & filed.

OLD BUSINESS – none.

NEW BUSINESS

Motion by Trustee Halliday, seconded by Trustee Enekes, approved purchase of a sewer line camera from Joe Johnson Equipment at the NJPA contract price of $9,753.75.
Carried – 3 – 0

Resolution #33 approved, budget transfer within sewer budget for payment of equipment purchase.

Motion by Trustee Enekes, seconded by Trustee Kelly, approved publication of public hearing to be held December 5, 2018 at 6:05 PM in the Firehouse, 16 Saratoga Ave. regarding Local Law 3 of 2018,  proposed changes to Village Parking Code.
Carried – 3 – 0

Proposed changes to the Water Law were tabled for further review by the Atty and Village Engineer.

Bids for the refinishing of the Firehouse apparatus bay floor were opened on November 2, 2018 with results as follows: Performance Industrial: 1/8” thick finish - $57,700.00; Ό” finish - $65,500.00.  Engine Bay Floors: 1/8” thick finish - $65,086.90; Ό” finish - $77,481.41.  Chief Kelley requested the Board table awarding a bid until he visited fire stations to evaluate the thickness necessary.

Motion by Trustee Enekes, seconded by Trustee Kelly, approved publication of public hearing to be held December 5, 2018 at 6:10 PM in the Firehouse, 16 Saratoga Ave. regarding the second required hearing for the 2016 CDBG Grant for Waste Water Treatment Plant construction.
Carried – 3 – 0

PUBLIC COMMENTS, QUESTIONS & CONCERNS

Don Dowen, Hill Ave, submitted his recent denial from the insurance company for Tom Kubricky Company in relation to a claim of damage to his furnace.  Mr. Dowen stated he feels the Village should pay the claim, Atty Buettner and the Board explained Village’s legal position regarding the matter.

Mayor Morreale requested an executive session to discuss litigation.

BOARD COMMENTS, QUESTIONS & CONCERNS

Trustee Halliday recommended the Village evaluate the use of LED lights for street lights.

Motion by Trustee Kelly, seconded by Trustee Enekes, that Board adjourn to executive session to discuss litigation as requested by Mayor Morreale, 6:54PM.Carried – 3- 0

At 7:16 PM the Board reconvened with no action taken in executive session.
