Village Board Minutes

October 6, 2010 (18)

A regular meeting of the Village Board was held October 6, 2010 at 6:00 PM in the firehouse, 16 Saratoga Ave.

Mayor Winslow called the meeting to order and Trustee Lescault led the Pledge of Allegiance.

Roll Call: Trustee Denno, Trustee Densmore and Trustee Lescault were present.  Trustee Enekes was excused.

Motion by Trustee Lescault, seconded by Trustee Densmore approved the minutes of regular meeting September 15, 2010 as typed.
Carried – 3 – 0

DEPARTMENT REPORTS

CLERK/TREASURER – Clerk/Treas Colson was present, report for 10/6/10 read & filed.

Clerk/Treas Colson stated the first annual monitoring report for the wetlands restoration at the DPW garage has been filed at the Village Hall.

Resolution #21 approved, adjustment to the water/sewer rolls.

Motion by Trustee Lescault, seconded by Trustee Densmore approved publication in the Pennysaver of leaf & brush pick up Oct 12 – Nov 15 and hydrant flushing Nov 15 – Nov 18.
Carried – 3 – 0

The Board discussed and decided to cancel the regularly scheduled Board meeting on October 20, 2010 in order to allow the Dissolution/Shared Services Committee to conduct their public information session on October 20 at 6:00PM with no time restrictions.  The Board encouraged the public’s attendance at the information session in order to offer input to the Committee.

Resolution #22 approved, cancellation of the October 20, 2010 regular Board meeting and authorization of payment of the bills for that period after audit.

Motion by Trustee Lescault, seconded by Trustee Densmore, approved payment of abstract #8: Payroll $26,914.70; General $171,515.39; Water $14,066.89; Sewer $11,491.45; Community Development $840.00 and Capital Reserves $4,000.00.

FIRE DEPARTMENT – Chief Kelley was present, report for September 2010 read & filed.

Firemen are currently attending numerous training classes including vehicle extrication and air pack training.

DPW/WATER/WWTP – Supt Lozier was present, report for September 2010 read & filed.

Leaf & brush pick-up will be October 12 – November 15.  Hydrants will be flushed November 15 – November 18.

The beach is winterized and this is the final weekend for the park to be open with attendants.

Supt Lozier & WWTP Operator Holmes have taken exams for the Class A water license and are awaiting the results.

Motion by Trustee Denno, seconded by Trustee Lescault approved publication in the Pennysaver of notice of parking prohibition on Village Streets from 11 PM – 6AM Nov 1 – April 1.

BUILDING INSPECTOR – Insp Jacon was present, report for 9/16 – 10/6 read & filed.

Board members alerted Insp Jacon to a tractor trailer parked on Walnut St and requested Insp Jacon issue the driver a warning of the violation of Section 132-26A of the Village Code.

The Board discussed the progress of the replacement of the elevator at Adam Lawrence apartments.  Atty Auffredou suggested Insp Jacon send a letter to the management company acknowledging their phone conversations and the projected time line for replacement advising them that the Village should be notified of any deviation from this time line.

ATTORNEY – Atty Auffredou was present, report for 10/6/10 read & filed.

The ZBA will meet Oct 27; the Planning Board will meet Oct 28, there is no new business before either Board.

The Board and Atty Auffredou discussed the concept of a Nuisance Abatement Law with a copy of Hudson Falls’ law as an example.  Atty Auffredou explained the mechanics and purpose of the accrued points system to deal with nuisance properties and stated the Saratoga County Sheriff’s office would need to cooperate in order for such a law to be successful in the Village.  Mayor Winslow will discuss the possibility with the Sheriff’s department before the Board pursues any further discussion.

OLD BUSINESS

No further update on GWUDI.

The next Dissolution/Shared Services Committee meeting will be held Wednesday, October 20 at 6:00 PM in the firehouse, 16 Saratoga Ave.  The Board encouraged members of the public to review the report available on the village website, www.villageofcorinthny.com, and to attend the meeting to address any questions or concerns with the committee.

The Board decided to hold a public hearing on a proposed local law amending the Parking Code to prevent the parking of specialty vehicles (tractors, cargo carriers, recreational vehicles, boat trailers, etc) on Village streets.

Motion by Trustee Lescault, seconded by Trustee Denno, approved publication in the Post Star and Pennysaver of a public hearing to be held November 3, 2010 at 6:00 PM in the firehouse, 16 Saratoga Ave re: prohibiting the parking of specialty vehicles on Village streets.

The Board discussed the possible sale of Village-owned property off of Wood Road, tax map #59.-2-69.2, and decided a survey would be necessary to determine if the Village will offer the property for sale.  Atty Auffredou will send a letter to the interested party outlining the Village’s position on a possible sale.

NEW BUSINESS

Atty Auffredou briefed the Board on a proposed settlement with National Grid regarding gross receipt taxes (GRT) that were in dispute from the period of Sept 2005 through December 2009.  A proposed settlement was negotiated on behalf of NY villages and cities by the New York Conference of Mayors (NYCOM).  Atty Auffredou offered the opinion that NYCOM did an excellent job of negotiating a settlement that protects the municipalities’ rights.  The proposed settlement waives National Grid’s right of recovery for GRT paid from 9/1/05 – 8/31/08 and the Village would waive rights to recover GRT not paid from 9/08 – 12/09; National Grid will continue to pay the GRT going forward while reserving the right to dispute payment if a third party challenge were to benefit them legally in the future.  Atty Auffredou advised that the agreement was a favorable resolution.

Resolution #23 approved, authorize the mayor to enter into a settlement agreement with National Grid on behalf of the Village.

Discussion on the proposal by Laberge was tabled to await further details from Laberge.

PUBLIC COMMENTS, QUESTIONS & CONCERNS

Jim Murray stated he believes the Village should promote Pagenstecher Park more among the area campgrounds.  Mr. Murray felt increased usage of the Park may increase downtown foot traffic.
