Village Board MinutesAugust 7, 2007 (16) An emergency meeting of the Village Board was held August 7, 2007, 4:00 PM in the Village Hall, 260 Main St. Mayor Winslow called the meeting to order. Roll Call: Trustees Denno, Densmore, Enekes & Lescault
were present. An in ground gas tank was discovered by the DPW at 250 Main Street while moving water services out of the sidewalk. Mr. Russell Boggs, owner of the property, and the DEC were contacted. Supt Lozier gave Mr. Boggs contact information for representatives at the DEC as well as the names & numbers of companies that remove hazardous material and can test for soil contamination. Mr. Boggs has since engaged a firm to assist him. Mr. Boggs requested that the Village DPW assist in digging out around the tank. Attorneys have advised that the Village not assist with the digging. Atty Avigdor is not able to represent the Village in this matter due to a conflict of interest. Resolution #30 approved to hire Dan Tyson to represent the Village in the matter of the in ground fuel tank at 250 Main Street at the rate of $265 per hour. Atty Tyson will send a written notification to Mr. Boggs advising him of the presence of the tank and his responsibility to contact the DEC. Sidewalk reconstruction will end 20 - 30 feet above where the tank is and resume 20-30 feet below the tank. JJP will then hand form the curbing in that area when the tank is taken care of. The Board discussed portable toilets for the Town wide Garage Sale. No one has requested the use of the Jessup’s Landing Park so the Board decided they did not need to provide portable toilets.
