Village Board Minutes

January 6, 2006 (56 )

A special meeting of the Village Board of Trustees was held Jan. 6, 2006, 9:30 AM at the Village Hall, 260 Main St.

Mayor Bradley Winslow called the meeting to order.

Present: Trustees Lescault and Densmore.

Also Present: Treas. Fuller, Acct. Clerk Mosher and Atty. Avigdor.

Attorney Avigdor reported on his Jan. 5th conversation with Tom Lindsey, attorney with a not-for-profit environmentally oriented law firm in Chambersburg, PA which was recommended by Louise Kirkpatrick. Their information and website may be useful as a resource to decide what kind of legislation to enact if the Village Board decides to adopt a moratorium, but this law firm is not licensed in New York State. Philmet has threatened a lawsuit if a moratorium is passed. Attorney Avigdor suggest that an upstate NY traditional environmental law firm should be hired by the Village if a lawsuit is anticipated.

Trustee Densmore discussed the type and disposition of the sludge already on Philmet property.  

Attorney Avigdor explained various options to explore such as hiring an environmental engineer and requiring a site plan review for all industrial uses. He recommended studying “proper” regulations.

ADJOURNMENT

Motion by Trustee Densmore, seconded by Trustee Lescault that Board adjourns to executive session for discussion of threatened litigation, 10:05 AM.
Carried 3 – 0

Board reconvened at 10:57 AM

Mayor Winslow stated that further discussion will be tabled until the next regular Board meeting; no action will be taken this morning.
