Village Board Minutes

August 27, 2008 (23)

A special meeting of the Village Board was held August 27, 2008 at 8:00 AM in the Village Hall, 260 Main St.

Mayor Winslow called the meeting to order.

Roll Call: Trustees Denno, Enekes and Lescault were present.  Trustee Densmore was excused.
Also Present: Atty Auffredou, Supt Lozier, Insp Jacon, Clerk Colson and property owner Jeffrey Dumont.

Motion by Trustee Lescault, seconded by Trustee Denno that Board convene as the Local Board of Health.
Carried – 3 – 0

Atty Auffredou stated the Board was meeting under Article 3 of the NYS Public Health Code to determine if a public health hazard was present at 205-209 Main Street and 215 Main Street.

Mayor Winslow read a letter from Dr. Pitkin stating in his opinion as the public Health Officer a potential health hazard exists at those locations.  Insp Jacon stated he has received complaints from residents about odor from uncapped sewer lines.  There are three exposed uncapped sewer lines which cannot be determined which of the two properties they belong to without a survey.

Jeff Dumont, owner of 205-209 Main St.  stated he is attempting to work with the other property owners to rebuild and cannot rebuild a building comparable to what existed previously on his own property due to zoning set-backs.  Financially Mr. Dumont is limited as to what he can do as well; he has considered selling the property.  Mr. Dumont has also attempted to keep water out of the foundation, but with the amount of rain it has been impossible.  Mayor Winslow stated he has met with Mr. Dumont several times and feels he has made efforts to move forward with rebuilding the property.

Mayor Winslow read a letter from David and Diane Densmore, owners of 215 Main St, stating they have pumped water out of the foundation and treated it with mosquito repellant and bleach in any standing water.  Mr. & Mrs. Densmore do not believe any of the uncapped sewer lines are on their property.

After extensive discussion the Board agreed that there is a nuisance existing that requires abatement within 30 days.

Resolution #37 approved, declared under the Public Health Law that a nuisance exists at 205-209 Main St which requires abatement and authorizes the mayor to issue an order declaring nuisance requiring abatement.

Resolution #38 approved, declared under the Public Health Law that a nuisance exists at 215 Main St which requires abatement and authorizes the mayor to issue an order declaring nuisance requiring abatement.

Motion by Trustee Lescault, seconded by Trustee Enekes that board adjourn Local Board of Health and special meeting, 8:45 AM.
